Frequently asked questions

What is a compliance program?

It is the set of policies, controls and responsible people a company uses to prevent, detect and correct legal breaches. An effective program starts from an analysis of the company's real risks, has management backing, trains staff, is monitored and is updated. It is a practice, not a document.

Which companies are regulated entities for anti-money laundering purposes in Venezuela?

Banking, securities and insurance institutions, and other activities identified by the LOCDOFT and sector rules, such as certain high-value businesses, exchange houses or payment service providers. Each regulated entity must appoint a compliance officer, know its customers and report suspicious transactions.

Can a company be held criminally liable in Venezuela?

Yes, where the law expressly provides for it. The LOCDOFT, for example, sets penalties for legal entities for offenses committed for their benefit, without prejudice to the liability of their directors. A well-implemented compliance program is the main tool for preventing that risk.
